A takedown request or comment moderation notice is actionable under the following categories:

  • Intellectual property: copyright or trademark infringement, unauthorized reproduction of proprietary text or media;
  • Civil & personal injury: defamation, cyberharassment, identity theft, or invasion of privacy;
  • Severe criminal offenses: hate speech, promotion of terrorism, or child sexual abuse material;
  • Cybersecurity threats: active exploit payloads, malicious phishing links, or malware distribution within comments.
In plain English: we remove unlawful content, copyright violations, defamatory statements, and malicious links.

Mandatory Information Required

To be legally actionable, your notification must include:

  1. Specific URL(s): exact location of the allegedly infringing material;
  2. Detailed description: nature of the violation and explanation;
  3. Contact details: full name, organization (if applicable), and email address;
  4. Authority statement: evidence of copyright ownership or legal representation;
  5. Good-faith statement: declaration under penalty of perjury that the claim is accurate and made in good faith;
  6. Electronic signature: full legal name acting as digital signature.
In plain English: provide the exact link, explain what is wrong, identify yourself, and confirm your statement in good faith.

Penalties for Bad-Faith Reports

17 U.S.C. § 512(f) · French Penal Code

Submitting fraudulent or bad-faith takedown notices to suppress lawful speech incurs severe civil and criminal penalties:

Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing shall be liable for damages, including costs and attorney's fees incurred by the alleged infringer or service provider. Under French law, fraudulent reporting carries up to 1 year imprisonment and a €15,000 fine.
